Medicare Set Aside Allocation

Prior to settlement in a workers' compensation case, a Medicare set-aside allocation is required by law (42 U.S.C. 1395Y) and is established from a portion of the WC settlement to ensure that the funds required to pay for future medical expenses are identified as they are related to the job injury, while taking the interests of Medicare into consideration.
